Why You Should Get Your Severance Package Reviewed

Your manager brings you into the boardroom where HR is present (or invites you to a Zoom meeting!). You are then told you are being let go and handed a severance package. You are likely shocked and the last thing you want to do is pay a lawyer to review it but the cost of this review may be one of the best investments in your life. Some reasons you should get your severance package reviewed are listed below.

To determine whether you are entitled to more termination pay

The offer in your severance package is rarely the employer’s final offer. There is usually  negotiation room built into the offer. By getting your severance package reviewed, an employment lawyer can provide you an assessment of how much termination pay you are actually entitled to. For instance, you may think an 8 weeks offer is all that you are owed when, in reality, you could be owed more like 8 months.

Our previous blogs further explain how a severance package review could increase your entitlements.

You could be giving up your rights to other claims

In addition to being owed termination pay, you may be owed monies for unpaid wages including overtime pay or bonus pay, or you could be owed human rights damages. An employment lawyer will consider these other potential legal claims.

By signing off on a severance package without getting it reviewed by a lawyer, you could be inadvertently giving up your rights to claim other sorts of damages related to your employment and/or the termination of your employment.

To assist you in finding alternative employment

Having your severance package reviewed can provide you the opportunity to attain non-monetary items that may not be available otherwise such as a reference letter. This could be extremely valuable in assisting you in finding another job.

For a general peace of mind

Getting terminated is very stressful. During this difficult time, most people want to know whether or not they are being treated fairly.  An employment lawyer can take the guesswork out of determining whether your severance package is fair or not and give you that peace of mind.

If you have been let go by your employer, you can contact Barrie and Toronto Employment Lawyer Marium Rehan at MacLeod Law Firm via [email protected] or 647-204-8107 to understand whether the severance package offered to you is reasonable.
